All the participants are required to duly fill in the below Declaration Form and Travel Risk Assessment form as given below and submit it to Hodophile Geo Holidays Private Limited’s representative before starting of the trip / trek.

INFORMED CONSENT, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

This agreement must be read and signed by every participant in adventure activity and be signed by their parent/guardian when a participant is a minor (under 18 years of age). This Agreement shall be effective and binding upon the participant’s heirs, next of kin, executors, administrators, assigns, and representatives, in the event of their death or incapacity.

I understand that certain risks and dangers will exist with field trips such as (but not limited to) loss or damage to personal property, injury or fatality. Some of the factors creating risk include, but are not limited to the following: weather changes, sunburn; physical exertion; dehydration; slippery rocks and steep slopes; high winds; natural calamity; rugged terrain; lightning; falling trees; encounters with wildlife; hazards of insects, reptiles, plants; travelling to remote areas without access to medical facilities; transportation failure (to and from trek areas), climatic conditions, risk of travelling in remote, unsafe or politically unstable areas, accident or illness in remote areas without access to medical facilities; riots; communal violence; and other risks that may not be foreseeable.

I acknowledge that while Hodophile Geo Holidays will make every reasonable effort to minimise risks, not all dangers associated with the activities can be foreseen. I accept the fact that, while the Service Provider is skilled and experienced, they cannot guarantee my safety since some risks are beyond their control.

I agree to behave in an appropriate manner and listen to all instructions given to me by staff/guide/instructor of Hodophile Geo Holidays. I understand that failure to comply with instructions will lead to my exclusion from the activity at the sole discretion of the Service Provider in the interest of other travellers.

I understand that Hodophile Geo Holidays will endeavour to provide me with an enjoyable and worthwhile activity session although there may be occasions when they cannot complete the whole activity, for example due to strong winds, poor weather, government restrictions or other unforeseeable conditions. In such cases, the sole discretion lies with the Service Provider for amendments of activity/trip.

In recognition of the inherent risks of the activity or trip in which I will engage, I confirm that I am physically and mentally capable of participating in the activity. My participation is voluntary and I will assume financial responsibility for personal injury, accidents, illness and damage to or loss of personal property as the result of any incident or accident that may occur. I accept full responsibility for any omissions or errors in non-disclosure of medical conditions in the declaration form. I agree that if for any reason I have to leave the activity early, I will not be entitled to any refund. Hodophile Geo Holidays will not be liable for any expenses incurred to me as a result.

Should I require emergency medical treatment as a result of accident or illness arising during the trip, I consent to such treatment. I agree to be financially responsible for any medical bills incurred as a result of any medical services that I receive.

I hereby RELEASE, HOLD HARMLESS, INDEMNIFY AND RELEASE ALL CAUSES OF ACTION against Hodophile Geo Holidays, its employees, officers, directors, vendors and contractors ("Released Parties") in connection with any injury, death, loss or harm (whether foreseen or unforeseen) that occur to me or to any other person or to any property during the Travel/Activity. This release does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that Indian law does not permit to be released by agreement.

If any dispute or difference(s) of any kind whatsoever shall arise between the parties hereto in connection with or arising out of this agreement the parties hereto shall in good faith negotiate with a view to arriving at an amicable resolution and settlement. Any/all legal proceedings with regard to any matter, claim, differences and disputes arising out of this agreement, will be governed by the Indian laws and the courts of Hyderabad, shall have exclusive jurisdiction over any claim arising out of it.

I have carefully read this form before signing it and I voluntarily accept the risks described herein. No representations, statements or inducements, oral or written, apart from the foregoing written statement, have been made. I agree that if any portion of the present agreement is found to be void or unenforceable the remaining portion shall remaining force and effect.
